These Terms of Use and End User License Agreement ("Agreement" or "Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Nembly Studio ("Nembly Studio," "we," "us," or "our"), a sole proprietorship registered in Norway, governing your access to and use of Golden Egg: Can You Crack? ("App" or "Game") on iPhone and Apple Watch, and any related services.

By downloading, installing, or using the App, you confirm that you have read, understood, and agreed to be bound by this Agreement. If you do not agree, do not download or use the App.

This Agreement incorporates and is subject to Apple's standard End User License Agreement for App Store applications, available at apple.com/legal/internet-services/itunes/dev/stdeula/.

1. The game

Golden Egg: Can You Crack? is a free-to-play idle clicker game available on iPhone, with an optional Apple Watch companion. Players tap a golden egg to progress, upgrade their hatching speed, and unlock new content. No internet connection is required for core gameplay. The App is free to download; certain features and items are available through in-app purchases as described below.

2. License grant

Subject to your compliance with this Agreement, Nembly Studio grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices you own or control, solely for your personal entertainment, in accordance with Apple's App Store Usage Rules.

This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise distribute the App or any content therein.

3. In-app purchases

3.1 Consumable items

Golden Egg offers consumable in-app purchases — items such as in-game currency or speed boosts that are used up after purchase and must be purchased again if you want more. Consumable items have no monetary value outside the App, cannot be transferred between players, and are not refundable once used. If your device is lost, reset, or the App is deleted, unused consumable items may be lost and are generally not restorable.

3.2 Non-consumable items

The App also offers non-consumable in-app purchases — permanent unlocks such as Remove Ads and Swipe Mode — which are purchased once and retained permanently. Non-consumable purchases are tied to your Apple ID and can be restored on any device associated with the same Apple ID by using the "Restore Purchases" function within the App.

3.3 No real-money gambling

Golden Egg is a game of entertainment. There is no real-money wagering, no cash prizes, and no way to win, earn, or withdraw real money, cryptocurrency, or any item of monetary value. In-game items have no value outside the App and cannot be exchanged for cash or any real-world benefit.

3.4 Rewarded advertising

The App offers an optional "Watch Ad" feature that rewards you with in-game items in exchange for viewing a short video advertisement. This is separate from any in-app purchase. No payment is required to access this feature.

3.5 Pricing and refunds

Prices for all in-app purchases are displayed within the App at the time of purchase and may vary by region due to local taxes and currency conversion. All payments are processed by Apple. Nembly Studio does not process payments or refunds directly. Refund requests must be submitted to Apple at support.apple.com.

4. Advertising and App Tracking Transparency

The App displays advertising from third-party advertising partners to support the free experience. Before any cross-app tracking occurs, iOS will display Apple's App Tracking Transparency prompt asking for your permission. If you grant permission, your device's advertising identifier (IDFA) may be used to personalise the ads you see. If you decline, contextual ads will be shown instead — no other aspect of gameplay is affected. You can change your choice at any time in Settings → Privacy & Security → Tracking.

5. Apple Game Center

Golden Egg integrates with Apple Game Center for leaderboards and achievements. Use of Game Center is subject to Apple's own terms of service and privacy policy. Nembly Studio does not control or have access to Game Center data beyond what Apple makes available to developers in aggregate form.

6. Apple Watch

An optional Apple Watch companion app is included at no additional cost. The Watch app syncs tap data directly between your iPhone and Apple Watch using Apple's WatchConnectivity framework. No Watch or tap data is transmitted to any external server.

7. Intellectual property

The App, including its design, artwork, game mechanics, audio, source code, and all related content, is owned by Nembly Studio and is protected by Norwegian and international intellectual property law. All rights not expressly granted in this Agreement are reserved. In-game items, currency, and content are licensed to you, not sold — you own no intellectual property rights in any in-game content.

8. Restrictions

You agree not to, and not to assist others to:

• Reverse engineer, decompile, or extract the source code of the App;
• Modify, adapt, or create derivative works based on the App;
• Sell, rent, sublicense, or redistribute the App or any in-game items;
• Use cheats, bots, automation, or exploits to gain an unfair advantage;
• Circumvent any purchase verification or access-control mechanism;
• Remove or alter any proprietary notices in or on the App.

9. User content and game data

Game progress is stored locally on your device. Nembly Studio does not provide server-side backup. If you delete the App, your progress may be permanently lost. Non-consumable purchases can always be restored via "Restore Purchases." Nembly Studio is not liable for any loss of game progress or consumable items resulting from App deletion, device reset, or any cause outside Nembly Studio's control.

10. Updates and changes

Nembly Studio may release updates that add, modify, or remove features and in-game content. Continued use after an update constitutes acceptance of any changes. Nembly Studio reserves the right to discontinue the App or any feature at any time, with reasonable notice where practical.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. Nembly Studio does not warrant that the App will be uninterrupted, error-free, or compatible with every device or operating system version.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEMBLY STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF IN-GAME PROGRESS, LOSS OF CONSUMABLE ITEMS, OR LOSS OF PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NEMBLY STUDIO'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50.00, WHICHEVER IS GREATER. Nothing in this Agreement limits rights you may have under applicable mandatory consumer protection law.

13. Governing law and disputes

This Agreement is governed by the laws of Norway. Disputes shall first be attempted to be resolved through good-faith negotiation, then by the competent courts of Norway. If you are a consumer in the EEA, mandatory consumer protection rights in your country of residence also apply. Norwegian consumer protection legislation (including forbrukerkjøpsloven) takes precedence over any conflicting term here.

14. Apple-specific terms

• This Agreement is between you and Nembly Studio only. Apple is not a party and is not responsible for the App.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of a warranty failure, you may notify Apple for a refund of any purchase price paid. Apple has no other warranty obligation regarding the App.
• Apple is not responsible for any product liability, consumer protection, or intellectual property claims relating to the App.
• Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it upon your acceptance.

15. Severability and entire agreement

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions continue in full force. This Agreement, together with Apple's standard EULA and the App Store Terms of Service, constitutes the entire agreement between you and Nembly Studio regarding the App.

16. Changes to this agreement

We may update this Agreement at any time. Material changes will be reflected by updating the date at the top of this page. Continued use after changes constitutes your acceptance.
